The Legality on being a US poker affiliate

Lots of people are asking if being a US Poker affiliate is legal or not. However, this question cannot be answered by a yes or no even if it had been asked for years because “it really depends”.
The reason behind this answer is that there are no laws regarding online marketing of poker which says that it is illegal. However, there are some laws that prohibit poker and not being a poker affiliate. The explanation regarding this question is till vague because even scholars do not know how to answer it in a clear way. An attorney cannot even answer this question without leaving some doubts on our mind because every attorney has a different explanation for it.
On the one hand, there was no reported case that a poker affiliate had been arrested or some sorts like that. There has also been no case reported that an affiliate marketer has been sued for its illegality. If there is a case, it would be tax evasion or money laundering. The government then has never been strict even to kids who are poker affiliates and earn thousand dollars a month or even those who get millions a day.
Most bloggers who write about this topic basically shares their mere opinion. Because the topic is still vague to discuss, you cannot rely to anybody that they can tell you the exact answer to it. There is no such thing as that. What they are basically doing, just like what I am doing right now, is to study the situation and apply everything that they know about it. Even if the legality is being questioned these days, many will still be poker affiliates because the government says or does nothing to answer this question. Perhaps, it really depends upon how you will give reasons when you were asked.
